I started this petition because I believe every parent should have the right to make important decisions about their children's lives. Including, eliminating toxic relationships that are detrimental to their children. Every grandparent has already had that opportunity. The grandparent statute in Montana was meant to give grandparents visitation to their grandchild, in situations when parents have been incarcerated. However, some people take advantage of the statute. For example, in one case in Montana alone, the grandparents 1: Falsified evidence to take children away from a mother, 2: Made false police reports, 3: Made a false claim to the Department of Family Services, 4: Refuse to adhere to parent's wishes and two doctors orders in regards to a child's healthcare, 5: Maliciously continue to bully, threaten, intimidate, and financially ruin the children's mother, 6: Listen to the children's father say on the witness stand that he tried to kill their mother while she was pregnant, yet continue to try to get him full custody and allow him to live with them, 7: Made false claims in affidavits, 8: Do not provide the courts with any supporting evidence, 9: Slander the mother in the community, 10: Acuse the mother of multiple mental disorders without any prior attempt to resolve these mental disorders in the mother's life,(she does not have any, this is the mother's vindictive parents) etc. The atrocities continue on. This case needs a Dr. to diagnose the parents as gas lighters. This is the problem in this case. Please look up gas lighting. Please allow this family and any future families some peace of mind to get away from their abusers. 8 states including: Alabama, California, Florida, Iowa, New Jersey, New York, Tennessee, and Washington have already ruled that the grandparent statute or law is unconstitutional. Altering or abolishing this statute can increase the rights of parents.
Update on this matter: CPS has lost the file information the grandparents made against the daughter. The information the daughter has will be posted in various parental rights and CPS groups on facebook so everyone can see the file. Also see that it did happen. A CPS worker said she likes the grandparents and think they are doing what is right for the children and will not help the mother in court. The judge on the case said in court that he made a change to the court order without any hearing, by writing a letter, (not supposed to be done/supposed to be against the law) after the grandparents were backed into a corner on the stand about how they were breaking the court order. The grandfather said the judge wrote the letter, the judge paused and agreed. There is no record of this letter in the court file(the mother asked to see it in court and the judge did not have a copy) the grandparents never received a copy, the mother and her lawyers never received a copy, and the school never received a copy(the judge said he sent it directly to the school). School administration said that never happens, judges don't send letters to schools like that and in the twenty plus years has never seen anything like it. This parent needs help changing this law!
